1. Introduction
These Terms of Service ("Terms") govern your use of services provided by Kaan Oral, trading as Qwebble ("we", "us", or "our"), a sole trader business based in the United Kingdom. We provide website development packages and optional ongoing web support subscriptions to customers ("you" or "Client"). By engaging our services, you agree to be bound by these Terms.

2. Services
We offer:

• Website development packages (the "Website Services")

• Optional web support subscriptions (the "Support Services")

Details of each service, including pricing and deliverables, are outlined on our website and confirmed in writing prior to commencement.

3. Eligibility
To use our services, you must:

• Be at least 18 years old

• Reside or operate a business within the United Kingdom

• Have the legal capacity to enter into contracts

4. Orders and Payment
4.1 Website Services: Depending on the website package a written quote will be provided or prices will be shown on the website package store (prices are subject to change at any time). A deposit of 50% is required before work begins, with the remainder of the balance due upon completion and paid in a timely manner within 48 hours of completion.
4.2 Support Services: Subscriptions are billed monthly or annually in advance. Payment must be received before services commence.
4.3 All prices are in GBP (£) and inclusive of VAT (if applicable).

5. Client Obligations
You agree to:

• Provide accurate information and timely feedback

• Supply required content if necessary (e.g. text, images, branding assets)

• Ensure your content complies with applicable laws and does not infringe third-party rights

1. Service Overview

Qwebble offers a Website-as-a-Service (WaaS) subscription model. Clients pay a monthly fee in exchange for ongoing access to a professionally designed, fully managed website. The service includes:

• Custom website design and development

• Hosting and domain management (if applicable)

• SSL certificate and security features

• Ongoing maintenance and performance optimization

• Monthly support and minor content edits (up to 1 hour/month)

2. Subscription & Payment Terms

• The standard subscription fee is £119/month.

• The minimum contract term is 24 months, beginning from the date of your first payment.

• After 24 months, your subscription automatically renews on a monthly basis unless cancelled in writing.

• Payments are collected via your preferred payment method on a recurring monthly basis.

• All payments are non-refundable.

3. Ownership and Intellectual Property

• Qwebble retains full ownership of all website files, source code, assets, and related intellectual property during the subscription period.

• You are paying for access, not ownership.

• After 24 months, you may request a buyout (see Section 6) to transfer ownership to you for a one-time fee.

• Without a buyout, ownership remains with Qwebble indefinitely.

4. Cancellation Policy

• Early Cancellation: If you choose to cancel before the 24-month minimum term is complete, you are responsible for paying the outstanding balance of the agreement.

• Post-Term Cancellation: After the 24-month period, you may cancel your subscription at any time with at least 14 days' notice before your next billing date.

• Upon cancellation:

  • Your website will be deactivated and removed from our servers within 7 days.

  • You will no longer have access to any files or services unless a buyout has been arranged.

5. Service Scope

Included in your monthly subscription:

• Minor content updates (e.g. text/image changes) up to 1 hour per month

• Regular maintenance, plugin updates, and security monitoring

• Hosting and basic email setup (if applicable)

Not included:

• Major redesigns or rebranding

• Custom functionality development beyond initial scope

• SEO strategy, advertising, or digital marketing
  (These services may be available for an additional fee.)

6. Optional Buyout

After completing 24 monthly payments, you are eligible to request full ownership of your website by paying a one-time buyout fee of £1,000.

The buyout includes:

• Transfer of website files and database (if applicable)

• Transfer of domain (if registered through Qwebble)

• Handover of admin access and documentation

Once the buyout is completed, Qwebble relinquishes ownership and ongoing responsibility for the website. Hosting and support services will cease unless separately contracted.

7. Late Payments

• A 7-day grace period applies for missed payments.

• After 7 days of non-payment, your website may be temporarily suspended.

• After 30 days of non-payment, Qwebble reserves the right to permanently remove the website and terminate the contract.

• Reinstating a suspended website may incur an administrative fee of £50.

8. Client Responsibilities

You agree to:

• Provide timely access to information, materials, and feedback required for development or updates

• Use the website in compliance with all applicable laws

• Not engage in activities that harm the website, our servers, or other clients

• Respect intellectual property and confidentiality clauses

9. Limitation of Liability

Qwebble shall not be held liable for:

• Loss of business, data, or profits resulting from downtime or technical issues

• Client misuse or unauthorised access

• Third-party service failures (e.g., domain providers, payment processors)

• Delays caused by missing content or feedback from the client

10. Termination

Qwebble reserves the right to terminate services immediately if you:

• Violate these Terms

• Engage in fraudulent or illegal activities

• Damage Qwebble’s reputation, systems, or clients

In such cases, no refunds will be provided and access to the website may be revoked.

11. Modifications to Terms

We may update these Terms of Service periodically. Continued use of our services after updates constitutes acceptance of the revised Terms. You will be notified via email or our website of any material changes.
